Welcome to Elevated Post, a service of Very Good Post LLC ("Company," "we," "us," or "our"). By subscribing to our services, you ("Subscriber," "you," or "your") agree to be bound by the following terms and conditions (the "Terms of Service" or "Agreement").
Description of Service
Elevated Post offers a monthly subscription-based post-production service for audio and video content ("Service"). Subscribers can choose from three (3) subscription plans: Audio, Video, and Complete (both Audio and Video). Each plan is structured on a 31-day term, billed monthly.
Subscription Plans and Payments
Subscription Plans: Subscribers can select from the Audio, Video, or Complete plans. Each plan's specific benefits and limitations are detailed on your dashboard.
Payments: Subscription fees are billed on a monthly basis at the start of each subscription term of 31 days. Payment details provided by you will automatically be charged at this time.
Refunds and Cancellation
No Refunds: All payments are non-refundable. Please choose your plan carefully.
Cancellation and Pause: You may pause or cancel your subscription at any time via your subscriber dashboard. Upon pausing, your account will not be billed for the subsequent period until you resume.
Credits: Any days unused at the time of pausing or canceling will remain as credits on your account. These credits can be used at any time in the future, up to 12 months from the original subscription date.
Use of Service
Project Requests: Subscribers can request projects to be completed through their dashboard. Projects will be addressed one at a time.
Unlimited Projects: Active subscribers may request an unlimited number of projects. However, each project will be queued and completed sequentially.
Responsibilities: Subscribers are responsible for providing all necessary files and information required for each project. The Company is not responsible for delays resulting from incomplete or incorrect submissions.
Intellectual Property
All content created by Very Good Post LLC as part of the Service will remain the intellectual property of the Subscriber. However, the Company reserves the right to use completed projects for promotional purposes unless explicitly requested not to do so by the Subscriber.
Assets Provided by Very Good Post LLC
All assets provided directly by Very Good Post LLC as part of the Service, including but not limited to music, sound effects, stock footage, and images ("Company Assets"), are included for free and are licensed for commercial use by the Subscriber in projects completed through the Service. These Company Assets are sourced or created in a manner that grants the Subscriber the right to use them in their projects without additional licensing fees or restrictions.
Subscriber-Provided Assets
Subscribers may also provide their own assets ("Subscriber Assets") for use in projects. It is the sole responsibility of the Subscriber to ensure that all Subscriber Assets are appropriately licensed for use and do not infringe upon the rights of third parties. The Subscriber indemnifies Very Good Post LLC against any claims, damages, losses, or legal actions arising from the use of Subscriber Assets that violate the rights of third parties or are not properly licensed for commercial use.
By submitting Subscriber Assets for use in projects, the Subscriber represents and warrants that they have the necessary rights and permissions to use and to authorize Very Good Post LLC to incorporate these assets into their projects.
Liability
Very Good Post LLC assumes no liability for any infringement of copyright, trademark, or other intellectual property rights related to assets provided by the Subscriber. The Subscriber agrees to indemnify and hold harmless Very Good Post LLC from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from the use of any Subscriber Assets that infringe the rights of any third party or are not in compliance with this Agreement.
Amendments
We reserve the right to modify or replace these Terms of Service at any time. Subscribers will be notified of any changes through the contact information provided in their account.
